What actually makes a basement suite legal in Calgary?
What makes a suite legal?
"Finished basement" and "legal secondary suite" are not the same thing. A legal suite has to meet the City of Calgary's Land Use Bylaw and the Alberta Building Code, which comes down to four requirements:
A legal secondary suite has to meet four requirements under the City of Calgary's Land Use Bylaw and the Alberta Building Code:
1
Ceiling height
The most common blocker. Older homes are often built with lower basements than current code requires, so we check this first.
2
Egress windows
Any bedroom needs a window sized and placed for emergency exit, not just a small basement window.
3
Separate entrance
Usually required so the suite can be entered without going through the main home.
4
Permits & inspections
Development permit, building permit and final inspections with the City of Calgary.
Every legal suite conversion is checked against all four of these before we quote a design.

No. Ceiling height is the most common blocker, since older homes were often built with lower basements than the code requires. We check this early, before you spend money on a design that won't pass.
How long does the legal suite process take?
Permitting alone can take several weeks with the City, on top of the construction timeline for a standard basement development. It's a longer process than a basement finished for personal use, mainly because of the extra inspections.
What does it cost?
A conversion where the basement is already partially developed typically starts from $50,000. A full conversion, mostly new work, starts from $75,000. See legal basement suites → for the full breakdown.
